Genotec AG: Business policy on Internet use
Genotec AG and its associated companies offer, to private and corporate customers, different services in the field of information technologies including Internet access, different e-mail packages and services, data hosting on the World Wide Web and other services based on online technologies and the Internet. The direct or indirect execution of or participation in each of the following activities, insofar as they carried out using a service provided by Genotec AG, is contrary to the business policy of Genotec:
1) dispatching messages (postings) with essentially identical content to ten (10) or more Usenet or other news groups, forums, LISTSERV lists or other similar groups or lists (each of them is considered a "list").
2) posting intentionally articles to a list which do not correspond to the content of the list (i.e. are "off-topic") according to the charter, to another description published by the owner of the list or group or to the FAQ (Frequently Asked Questions);
3) sending undesired (unsolicited) e-mails to more than twenty-five (25) e-mail recipients, if it is reasonable to assume that this unsolicited e-mail will provoke complaints. If the applicable law states nothing to the contrary, messages are not to be considered "undesired e-mails" if (i) they are addressed to individuals with whom the sender maintains an already existing and persisting commercial or private relationship, and (ii) are sent by a non-commercial organization or entity of whom the individuals are currently members or (iii) are messages to a list (a posting), insofar this list isn't contrary to terms of usage in another way;
4) falsifying user data transmitted to Genotec AG or to other users in connection with the utilization of a service provided by Genotec AG;
5) participating in one of the above-mentioned activities by using the service of another provider insofar these activities are carried out via a Genotec AG account, a remailer (e-mail forwarding service) or are executed in any other way via a Genotec AG service or by using a Genotec AG account as receiving account for replies, or by using the services of another provider in any other way in order to render possible the above-mentioned activities if it's foreseeable that such a use of third-party services could have negative consequences for a Genotec service;
6) participating in any other activity which either represents a law infringement, endangers the integrity of a computer system or violates generally accepted standards of Internet use and behavior, including but not limited to denial-of-service attacks, alteration of other people's Web sites, port and network scanning, and unauthorized intrusion into a system.
Genotec AG considers the above-mentioned activities as misuse of our services and as abuse of the recipients of such undesired messages or postings who often must bear the resulting costs. Therefore, these practices are forbidden by the provisions of our General Terms and Conditions regarding the use of the services of Genotec AG. The participation in one or more of these practices can lead to the termination or blocking of the account at Genotec AG of the person responsible or/and the termination or blocking of her/his access to the services of Genotec AG according to the customer agreements of Genotec AG.
In addition, Genotec AG reserves the right, insofar as it practically feasible, to implement technical mechanisms
which inhibit the forwarding or the dispatching of the above-mentioned messages and postings to the anticipated recipients.
These business policy statements refer exclusively to the forms of network misuse which are specifically mentioned above. In addition to these activities, the General Terms and Conditions and the data use provisions of Genotec AG prohibit other forms of abuse such as molestation and the distribution of illegal or illicit material. Genotec AG will react to such activities in an appropriate way.
Nothing contained in these business policy statements must be interpreted as restricting the activities or counter-measures of Genotec AG vis-à-vis any of the above-mentioned activities. Genotec AG reserves the right to effectuate each and every supplementary action which seems appropriate to us in connection which such activities, including but not limited to activities which are aimed at passing on and recovering the costs and expenses for the identification of the user violating our business policy and for his or her exclusion from the services of Genotec AG, as well as the levying of termination fees to cover the expenses of Genotec AG in case of the deactivation of a dedicated access for the above-mentioned reasons. In addition, Genotec AG reserves the right to take at any moment all remedies available at law if such activities occur.
